Guilford, in Courtroom 10D, located at 411 West 4th Street, Santa Ana, CA 92701-4516, Plaintiff and Counterdefendant CTC Global Corporation (“CTC”), pursuant to Federal Rules of Civil Procedure 15 and 16, hereby moves this Court for an Order permitting CTC leave to modify the Court’s Scheduling Order and allow CTC to amend its Complaint (“Motion”). The Motion is warranted based upon new evidence obtained through discovery, and meet and confer efforts between CTC and Defendants Jason Huang, Rulong Chen, and James Huang concerning the need to amend the complaint to conform to the evidence. This motion is made following the conference of counsel pursuant to L.R. 7-3 which took place on February 19, 2019. (Declaration of Tamany Bentz in Support of Motion for Leave to Amend, ¶ 8.) This Motion is based on this Notice of Motion, the accompanying Memorandum of Points and Authorities, the proposed First Amended Complaint, supporting declarations and exhibits, all pleadings and papers filed in this action, and on such further written or oral argument as may be presented at or before the hearing.
