California has a liberal policy in favor of allowing amendment. Therefore, leave to amend will be allowed. The copy of the proposed amended complaint is identified in the caption simply as "Complaint for Damages." Correctly, the pleading should be captioned "First Amended Complaint for Damages." The clerks likely will not accept the proposed amended complaint if it is not correctly labeled. Therefore, plaintiff may interlineate by hand the words "First Amended" prior to "Complaint for Damages" at each place those words appear in the caption and the footer of the pleading before tendering it for filing.
