This estate has now been open for four years, with two 12-month extensions of time to close the administration granted. It appears from the reports that Petitioner Lisa Lupo has explored and exhausted most avenues for selling the Russian Porcelain Collection at its appraised value. It is clear that Petitioner has explored and exhausted many options for the sale of the Collection, all without success. Simply waiting and hoping for the "right buyer" is no longer the proper course. Due to the lack of cash in the estate, it appears the Collection is no longer insured. (Insurance cost was $745.04/mo.) Now, it appears it will no longer be stored in a secure, temperature-controlled facility but will be housed in Petitioner's home, uninsured. The Court denies the request for extension of time to to sell the Collection. Petitioner may have 30 days to determine if she wishes to buy the Collection herself. If she does not elect to do so, she is ordered to petition for final distribution as directed below, and distribute the Collection in kind to the beneficiaries. (PC § 12201(c)(2).) If she does elect to purchase the Collection, she shall also file a petition for final distribution as directed below. Petition for Final Distribution shall be filed by April 22, 2022, and is set for hearing on May 19, 2022, 9:00 a.m. in Dept.
