Super. - 2nd Dist.September 30, 2016123 Judge SUPERIOR COURT OF CALIFORNIA, TENTATIVE RULINGS EVENT DATE: EVENT TIME: VENTURA DIVISION August 30, 2019 09/05/2019 08:20:00 AM DEPT.: 40 COUNTY OF VENTURA JUDICIAL OFFICER: Mark Borrell CASE NUM: CASE CATEGORY: EVENT TYPE: CASE TITLE: CASE TYPE:Civil - Unlimited Breach of Contract/Warranty 56-2016-00487318-CU-BC-VTA JDP 21 VS BROOKS INSTITUTE Motion - Other (CLM) - to add judgment debtor CAUSAL DOCUMENT/DATE FILED: Motion - Other, 08/13/2019 stolo TENTATIVE RULING BY JUDGE REBECCA RILEY No notice of intent to appear is required. If you wish to submit on the tentative decision, you may send a telefax to Judge Riley's secretary at 805-289-8790, stating that you submit on the tentative. Please include the hearing date, the case name and case number on your telefax. Do not call in lieu of sending a telefax, nor should you call to see if your telefax has been received. If you submit on the tentative without appearing and the opposing party appears, you run the inherent risk of the hearing being conducted in your absence and the final ruling differing from the tentative. The Court's tentative ruling is to: Continue Plaintiffs/Judgment Creditors JDP 21 California, LLC, EC 101 Chestnut, LLC and California Gusher No. 83, LLC's Motion to Amend Judgment to September 26, 2019. CCP § 128. Supplemental opposition to be served and filed by September 13, 2019 and reply by September 19, 2019. Moving party to give notice. Discussion The footnote to the Plaintiff's reply indicates that Lin was personally served although no date is given nor is the proof of service attached. In light of the fact that Plaintiffs have now served Lin personally with the motion, The Court will continue the matter to allow Lin, and Green Planet, an opportunity to substantively oppose the motion as the opposition only dealt with the service issue. The Court finds that service on the Green Planet was sufficient. This motion is being brought per CCP § 187 not under CCP § 684.020. TENTATIVE RULINGS Page: 1
