A partial inventory/appraisal was filed on May 14, 2015, valuing decedent's real property at 301 Poplar Crest Avenue, Thousand Oaks, California. The administrator concedes that this asset is separate property. No mandatory Probate Code §12200 petition was filed, and it is currently seven months overdue. No additional inventory/appraisal was filed, despite the lengthy list of tangible personalty identified in a settlement agreement proffered by the administrator earlier this year. On July 6, 2016, decedent's daughter, Julia Salinas, petitioned to compel the administrator to account, to sell the real property asset, to distribute the uninventoried personalty, and to suspend and remove the administrator. Julia seeks to remove the administrator under a statute which no longer exists, which since 1991 has been controlled by Probate Code §8500 et seq. The administrator filed a "First Statement of Account" on August 10, 2016, which document purports to place receipts and disbursements on a single schedule and single page, with the rents received inaccurately reflected in the summary of account. It appears that petitioner is living in the estate residence and not paying rent, with no incentive to close the estate. The court suspends, sua sponte, the administrator, and appoints the Ventura County Public Administrator as temporary successor administrator. The Public Administrator is directed to complete the inventory/appraisal, collect a fair market rent and/or evict all residents as appropriate, sell the estate real property with or without tenants in order to maximize value, and an close this estate. A citation shall issue directing the administrator to show cause why she should not be removed as fiduciary.
