MAZZANT Relators’ Reply in Support of Motion for Leave to Amend Relators respectfully submit this reply in support of their motion for leave to file a Sixth Amended Complaint. As Relators stated in their opening brief (Dkt. 114), the proposed Sixth Amended Complaint simply makes clear that Relators’ allegations concerning Chase’s fraudulent misconduct with respect to HAMP modifications extend to both conventional and FHA-HAMP loans. Relators do not seek to “enlarge the litigation’s scope.” Resp. to Relators’ Mot. for Leave to Amend, at 5. And Chase’s suggestion that prior versions of Relators’ complaint did not comply with Rule 9(b) or Rule 11 is flat wrong and irrelevant. Because there is no bad faith or dilatory motive, the proposed amendment will not cause undue delay or prejudice to Chase, and Chase is effectively not opposing the proposed amendment, Relators respectfully ask this Court to grant their timely filed Motion for Leave to Amend.
