While Defendants are cognizant of the relevant case law regarding such motions, many of the documents discussed in the deposition transcripts that are attached to the Notice of Filing have been marked “Confidential” by a third party to the case. With the Pre-Trial Conference quickly approaching, the Parties have not been able to work through these issues with the third party, yet they felt it was important for the Court to have these transcripts in order to rule on certain objections to deposition testimony that were submitted with the Joint Pre-Trial Order. Therefore, Defendants respectfully move the Court for leave to file the above-referenced Motion to Seal and attached documents.
