(collectively, “LG”) will appear before the Honorable Roger T. Benitez in Courtroom 5A of the United States District Court, Southern District of California, located at 221 West Broadway, San Diego, California, 92101, to present LG’s Motion for Leave to File Excess Pages. LG, by its undersigned attorneys, respectfully moves the Court pursuant to Fed. R. Civ. P. 7(b) and Local Rule 7.1(h) for entry of an order granting LG leave to file a consolidated memorandum of points and authorities in support of its three Motions for Partial Summary Judgment that the Asserted Claims of: (1) U.S. Patent Nos. 8,867,351 and 8,787,924 are Invalid as Indefinite Under 35 U.S.C. § 112, ¶ 2; (2) U.S. Patent Nos. 8,787,924, 9,497,743, and 9,226,320 are Not Entitled to Plaintiffs’ Claimed Priority Dates; and (3) U.S. Patent Nos. 8,787,924, 9,497,743, and 9,226,320 are Invalid Under 35 U.S.C. § 102 (collectively, the “Motions”) in excess of twenty-five (25) pages, and not greater than forty (40) pages. LG bases its Motion upon this Notice of Motion and Motion for Leave to File Excess Pages, the accompanying Memorandum, and such further evidence, authorities, and argument as may be presented in advance of, or during, the hearing on this Motion.
