Powell (“Powell”) (collectively “Defendants”) will move this Court under Federal Rule of Civil Procedure 56, for an order granting partial summary judgment against Plaintiff Tracie Imblum (“Plaintiff”) on Plaintiff’s third cause of action for retaliation under the California Fair Employment and Housing Act (“FEHA”). The motion is made because: 1. Plaintiff has failed to create a genuine dispute of material fact over whether she suffered any adverse employment action; and 2. Plaintiff cannot establish a causal link between any alleged activity protected under FEHA and any adverse employment action. The motion will be based on this notice, the accompanying points and authorities, the declaration of Frank L. Tobin and the supporting evidence attached thereto, the pleadings and papers on file, any other document that may be properly judicially noticed, and any other evidence and argument as presented at the hearing.
