Civ. P. 16 for appointment of an impartial third party Mediator and refer Trinity Event Staffing and Plaintiff to mediation. In support of this motion Plaintiff would show: I. FACTUAL BACKGROUND 1. Samantha Carter (Plaintiff), filed this complaint on October 17, 2014 after being hired and supervised by Trinity Event Staffing demoted in her job title, placed in the garage due to the color of her Chef Jacket, received a wage cut in comparison to all other workers with her same job duties and description and was eventually set on fire by Butane Explosion due to the Case 3:16-cv-01554-N-BN Document 265 Filed 09/18/17 Page 1 of 5 PageID 2226 negligence of Trinity Event Staffing and other parties. The courts have ordered negligence, punitive damages and Title VII against Trinity Event Staffing in whom also declined medical attention to Plaintiff for 2-3 hours see Order in [Dkt. 260]. 2. On September 15, 2017, Plaintiff Carter received a settlement offer from Trinity Event Staffing in the amount of $5000.00, in which she indefinitely denied and she presented a counteroffer. However, do to the nature of this case and the Defendants purely expressive lack of human compassion throughout their motions in regards to the violation of Plaintiff Carter’s life and sufferings as a matter of law in which is the cause for this incident being in federal courts; The Plaintiff is requesting the courts to appoint a mediator so that every procedure in reference to this mediation may be lucid and no tactics will suddenly delay the results of the mediation and resolution, in which Trinity Event Staffing is now so eagerly requesting and have already begun without the involvement of the courts. WHEREFORE, the Plaintiff, SAMANTHA CARTER, respectfully requests this Honorable Court to immediately appoint a mediator for mediation and order an immediate mediation with Plaintiff and Trinity Event Staffing.
