PLAINTIFF LISLE’S MOTION TO STRIKE IDOC DEFENDANTS’ REPLY IN SUPPORT OF IDOC DEFENDANTS’ MOTION FOR SUMMARY JUDGMENT Plaintiff Steven Lisle, Jr. (“Plaintiff” or “Lisle”), by undersigned counsel, hereby respectfully moves the Court to issue an order striking the IDOC Defendants’1 Reply in Support of IDOC Defendants’ Motion for Summary Judgment. In support of his Motion, Plaintiff states as follows: 1. On November 27, 2018, IDOC Defendants filed their motion for summary judgment and supporting memorandum of law (collectively, the “IDOC Motion for Summary Judgment”) (Dkts. 126, 127.). 2. On January 31, 2019, Lisle filed his response in opposition to the IDOC Motion for Summary Judgment. (Dkt. 144.) 3. On February 7, 2019, IDOC Defendants filed their Reply in Support of IDOC Defendants’ Motion for Summary Judgment (“Reply”). (Dkt. 145.) 1 The “IDOC Defendants” include Dr. Sylvia Butler, Andrew Bennett, Richard Harris, Frank Eovaldi, Christopher McClure, Michael Laminak, Brandon Anthony, Tracy Harrington, Virgil Smith, and Tonya Smith. Pursuant to Local Rule 7.1(c), “Reply briefs are not favored and should be filed only in exceptional circumstances. The party filing the reply brief shall state the exceptional circumstances.” (Emphasis added).). 5. Contrary to Local Rule 7.1(c), no exceptional circumstances warranted the filing of IDOC Defendants’ Reply. In fact, the IDOC Defendants have not and cannot state any exceptional circumstances in support of their Reply. 6. Accordingly, IDOC Defendants’ Reply must be stricken. WHEREFORE, Plaintiff Steven Lisle, Jr. respectfully requests that this Court enter an Order: (a) Striking IDOC Defendants’ Reply in Support of IDOC Defendants’ Motion for Summary Judgment (Dkt. 145); and (b) For any other relief this Court deems just.
