Santa Ana Blvd., Santa Ana, CA 92701, Defendant and Cross-Complainant Otay Village (San Diego) ASLI V, L.L.L.P (“OSVD”) will and hereby does move the court for summary adjudication on the following issue: Issue 1: On The First Cause Of Action Of Its Cross-Complaint To Set Aside Void Judgment On The Grounds That There Is No Defense To The First Cause Of Action Because The Undisputed Facts Establish That The HCR Judgment Is Void As A Matter Of Law Because HCR Did Not Exist As A Legal Entity When It Obtained The HCR Judgment. This Motion is based on the undisputed facts, which establish that the judgment obtained by Cross-Defendant HCR Moorpark Investors, LLC (“HCR”) in Los Angeles Superior Court Case No. BS135115 on March 1, 2012 (amended March 5, 2012) against Defendants North Park Communities, LLC (“North Park) and Forstar, LLC (“Forstar”) (the “HCR Judgment”) is void as a matter of law because HCR did not exist as a legal entity when it obtained the HCR Judgment. ! OVSD therefore seeks an order that the final judgment in this action, shall, in addition to any matters determined at trial or by judicial adjudication, award a judgment as established by such trial or adjudication.
