BLANKSBY PLEASE TAKE NOTICE that on June 6, 2019 at 8:30 a.m., Plaintiff California Institute of Technology (“Caltech”) will and hereby does move the Court pursuant to Federal Rule of Evidence 702 and the Supreme Court’s Daubert decision to exclude improper claim construction opinions of Dr. Stark and Dr. Blanksby. This Court previously rejected attempts by Defendants Broadcom Limited, Broadcom Corporation, Avago Technologies Limited, and Apple Inc.(“Defendants”) to limit the claims-at-issue to specific embodiments and implementations. D.I. 213 at 31-34. Rather than complying with the Court’s Claim Construction Order, Defendants’ non-infringement experts—Dr. Stark and Dr. Blanksby—simply ignore it by (1) relying on the same imported limitations rejected by the Court, and (2) improperly importing new limitations into claim terms that were not identified by Defendants as requiring construction. In both instances, Defendants’ experts’ non-infringement opinions rely on improper constructions and are, therefore, irrelevant and thus unhelpful, and should be disregarded. This motion is based on this Notice of Motion and Motion; the concurrently- filed Memorandum of Points and Authorities in Support of Caltech’s Motion to Exclude Improper Claim Construction Opinions of Dr. Stark and Dr. Blanksby; the concurrently-filed Declaration of Todd M. Briggs (and all exhibits thereto); the concurrently-lodged [Proposed] Order Granting Caltech’s Motion to Exclude; the files and records in this action; and any such additional argument or materials as may be submitted to the Court before the time of the decision in this matter. This motion is made following the conference of counsel pursuant to C.D. Cal. L.R. 7-3, which took place telephonically on March 13, 2019. RELIEF REQUESTED Caltech respectfully requests that the Court grant Caltech’s Motion to Exclude Improper Claim Construction Opinions of Dr. Stark and Dr. Blanksby.
