Plaintiffs believe that Defendants Response to Plaintiffs Motion for Continuance contains exhibits that constitute communications between counsel that were produced in violation of Judge Robreno’s local rule I(B). Hearing on Plaintiffs Motion for Continuance is set for 3:00pm on March 18, 2019. Because Defendant’s response relies on documents produced in violation of the rule, Plaintiffs respectfully request that a hearing on Plaintiffs Motion to Strike those exhibits in violation of the rule be had concurrently with the scheduled hearing on Plaintiffs Motion For Continuance on March 18, 2019. Plaintiffs concede that if Plaintiff’s interpretation of the Court’s rule is incorrect, then this motion should be denied. However, if Plaintiffs have properly interpreted the rule, Plaintiffs assert that the honorable Judge should not consider the documents contained in Defendants Case 2:16-cv-02362-ER Document 115 Filed 03/15/19 Page 1 of 4 response per Plaintiffs earlier motion to strike and that Plaintiffs be afforded an opportunity to argue said motion to strike before hearing on Plaintiffs Motion for Continuance. This motion is not made for the purpose of delay but so that justice may be done.
