That is wrong. Plaintiffs explained the procedural nature of this Motion during a meet and confer on September 14, 2017, at which time Bwin expressed its understanding. Defendants’ Response is thus misleading. As an initial matter, Plaintiffs have already produced all documents required by this Court’s September 6, 2017, Order. ECF No. 101 at 6 (“[O]n or before September 15, 2017, Plaintiffs must serve on Defendants all documents held by the Cantor affiliates”). Plaintiffs did so on September 15, 2017, as required by the Order. Ex. A at 1; Ex. B at 1 (service emails to counsel for Bwin and 888 Holdings). Although Plaintiffs disagree with the Order, Plaintiffs have not requested “reconsideration” or “reversal” in their Motion for Clarification. ECF No. 111 at 2. Rather, Plaintiffs have complied with the Court’s Order. With respect to the portion of the Order related to FanDuel’s Requests for Admissions, ECF No. 101 at 6, Defendants concede that they did not join FanDuel’s requests, despite having joined FanDuel in other consolidated requests for discovery. See Case No. 2:16-cv-00801-RCJ- VCF (D. Nev. July 25, 2017), ECF No. 214 at Ex. 2 (“Plaintiffs’ Reponses to Defendant FanDuel’s First Set of Requests for Admission” (emphasis added)). Defendants do not dispute that FanDuel is no longer subject to this Court’s jurisdiction and do not dispute that FanDuel is the only signatory to those non-consolidated Requests for Admissions. Ex. C at 2-3 (service copy of FanDuel’s Requests for Admission). In other words, it is undisputed that no requests for admissions have been served by Defendants in the cases pending before this Court. There is nothing for Plaintiffs to “supplement.” ECF No. 101 at 6. Rather than burden this Court with an Opposition filled with hyperbole, Defendants should have served their own requests for admissions in their own cases, to which Plaintiffs would have timely responded under the Federal Rules. . . . . . . . . . . . . . . . . . .
