CERTIFICATION OF MEET AND CONFER Pursuant to Civil L.R. 5(g)(3)(A), plaintiffs Michael Kantor, SLM Holdings Limited, LLC, 3 Wise Ventures, Inc., and Cabbage Tree Investments, LLC certify that they have met and conferred with counsel for defendants Big Tip, Inc. (“BigTip”), WhoToo, Inc. (“WhoToo”), Demandbase, Inc. (“Demandbase”), and Matt Rowlen, in an attempt to reach agreement on the need to file the documents under seal, to minimize the amount of material filed under seal, and to explore redaction and other alternatives to filing under seal. Counsel for plaintiffs met and conferred with counsel for defendants via email on January 22, 2018. Included in this email were David Freeburg, Anne Cohen, Nate Somers, Hozaifa Cassubhai, Ben VandenBerghe, Andre McGee, Sharlei Hsu, Paul Chandler, Deborah McClure, and Rachel Evans. The defendants did not agree to withdraw their confidential designations. II. MOTION Because this dispute stems from a company that closed in 2012, plaintiffs Michael Kantor, SLM Holdings Limited, LLC, 3 Wise Ventures, Inc., and Cabbage Tree Investments, LLC do not believe there is any grounds to outweigh the right of public access to court records or to seal the exhibits submitted in support of their opposition to the Defendants’ motion for judgment on the pleadings and the Defendants’ motions for summary judgment. However, at the insistence of defendants Big Tip, WhoToo, Demandbase, and Matt Rowlen and pursuant to the protective order entered in this case (Dkt. No. 84), the Plaintiffs submit this motion to file under seal so that the Defendants shall have an opportunity to argue in support of their position.
