Searle LLC, and Pfizer Asia Pacific Pte. Ltd. (“Pfizer” or the “defendants”) from presenting any evidence or argument at trial that a large judgment against them will negatively impact their current businesses and/or other brand drug manufacturers in the future. The direct purchasers also request that the Court preclude Pfizer from arguing or suggesting that the company will need to adjust the prices it charges for Celebrex and/or other products in the event of an adverse verdict. Finally, the direct purchasers request that this Court prohibit Pfizer from offering evidence or argument that suppression of generic competition to Celebrex was in any way beneficial or procompetitive because it, inter alia, (1) permitted Pfizer to recoup research and development expenses, (2) generated profits which Pfizer used to develop new drugs or otherwise benefit the public, or (3) enhanced the incentives of Pfizer and the branded drug industry in general to innovate.
