Carpet deduction. Based on your receipts for carpet installment on 3-1-1 5, the carpet installment fee was $1292, not as you mentioned was $1859. The common method of calculating the deduction for replacement is to prorate the total cost of replacement so that the tenant pays only for the remaining useful life of the item that the tenant has damaged. With a life expectancy of nine years and if a replacement carpet of similar quality would cost $1292, the landlord could propedy charge only $22 for the one month' worth of life (use) that would have remained. Since we only live in the premise for one month, we only need to cover the professional carpet cleaning fee. which is 277.17. Thus. l request that landlord need to return the amount of security deposit for carpeting section, which is total $355.69. 2. Painting deduction. When we moved out, there were some minor scuff marks and nicks in a one wall in the living room. in one wall in the kitchen room and there is no marks left in the bathroom. ln addition. there were some minor scuff marks only left on the baseboards in the kitchen. We think those minor scuff marks are normal wear and tear, which means tenants should not responsible for the those painting fees. Moreover, there were not obvious marks left on the doors (bedroom, hallway, and closet doors) except the bathroom door. Thus, I request that landlord need to return the amount of security deposit for painting section, which is total $1 270. 3. For the charge of "Patch Kitchen Linoleum", we disagreed this charge because there was no damage we made for kitchen floon'ng. Thus, we request that landlord need to return the full amount of this charge, which is $90. 4. For the charge of “Fix and clean coat cabinets”, | disagree that | am fully responsible for the bubbled-up cabinet surface. Because the cabinet is so close to the stove and there is no heat shield installed. the surface of cabinet is more vulnerable to be bubbled up while cooking. Due to the cabinet design flaw, we think landlord should take part of responsibility. Thus, | request that landlord need to return the partial amount of this charge, which is $125. 5. Late fee. According to California state law implies that you can only charge a “reasonable estimate of the amount that the lateness of the payment will cost the landlord.” In other words. the most common late rent fee would be a 5% fee of the rent value. Since our rent for July is $163.34, but the late fee you charge is $100, which is almost 61% of the rent vaIue. The charge fee is literally unreasonable even though we signed the lease. Thus, | request that landlord need to return the partial amount of this charge, which is $75. 6. New bathroom flooring. Since we haven't received any receipt about the flooring you installed. we disagreed with the charge for the damage. Thus, | request that landlord need to return the amount of this charge. which is $80. 7. Side of refrigerator paint.
