The grounds for this removal are as follows: 1. On February 24, 2020, PlaintiffDaCory Satterwhite (“Plaintiff”) filed a Complaint for negligence in the Santa Clara Superior Court, Case No. 20CV363848, against the United States Postal Service (“USPS”), a federal agency of the United States of America. True and correct copies of the Summons, Complaint and Civil Case Cover Sheet are attached hereto as Exhibit A. The Complaint asserts a cause 0f action for professional negligence. In the Civil Case Cover Sheet, Plaintiff demands monetary damages from Federal Defendant in excess of $25,000.00, non-monetary relief, and punitive monetary damages. The Agency received the Summons and Complaint by mail on February 27, 2020, which is not proper service under either state 0r federal law. On March 11, 2020, the United States Attorney’s Office received the Summons and Complaint from the Agency. Plaintiff has not served the United States Attorney’s Office with the summons and complaint. Likewise, the Attorney General of the United States in Washington, D.C. does not appear t0 have been served With the Summons and Complaint pursuant to Federal Rule of Civil Procedure 4(i)(1)(B). N0 trial date has been scheduled. 2. Plaintiff makes the following allegations in the Complaint: Plaintiff was approved for a credit card processing machine from Leaders 0f Merchants. Plaintiff received USPS tracking information that the package had arrived at the post office 0n January 18, 2020 at 1:19 am. When Plaintiff went to pick up the package the same day, an employee for the United States Postal Service told Plaintiff that the package had the wrong zip code and was not there. Plaintiff left without the package and called the Leaders 0fMerchant and was told they had sent the package. It is not clear from the Complaint Whether Plaintiff ultimately received the package. 3. Upon removal, the United States is automatically substituted as the party defendant pursuant t0 28 U.S.C. § 2679(d)(2). The claims against the USPS will proceed against the United States under the FTCA in the same manner as any action against the United States filed pursuant to 28 U.S.C. § 1346(b), subject to the limitations and exceptions applicable to those actions. 28 U.S.C. § 2679(d)(4). This action must be removed t0 federal district court pursuant t0 28 U.S.C. § 1442(a)(1) because Plaintiff has sued a federal agency, the United States Postal Service. Federal Defendants are entitled to assert the defenses provided by the Federal Tort Claims Act, including failure to exhaust administrative remedies, and the defense provided by 28 U.S.C. § 2680(b) (The United States is not liable for “any claim arising out of the loss, miscarriage or negligent transmission of letters or postal matter.”). 5. Additionally, a civil action in state court seeking damages from a federal agency may be removed to federal court provided that the defendant has a colorable federal defense or can otherwise articulate a connection between the performance of his 0r her duties and the acts or omissions alleged. See 28 U.S.C. § 1442. Actions against federal agencies or officers are considered “exceptional . . . [u]nder the federal officer removal statute, [because] suits against federal officers may be removed despite the nonfederal cast of the complaint; the federal-question element is met if the defense depends on federal law.” Jefferson Cnly., Ala. v. Acker, 527 U.S. 423, 430-31 (1999). Section 1442 is broadly construed to favor removal in the case of actions against federal agencies 0r officers. Durham v. Lockheed Martin C0rp., 445 F.3d 1247, 1252-53 (9th Cir. 2006). For example, “a federal officer or agency defendant can unilaterally remove a case under section 1442.” Id. at 1252. A broad interpretation furthers one of the key purposes 0f the statute: to provide a federal agency that has been sued in state court for acts done in the name 0f the federal government with an opportunity t0 have the validity of defenses based on federal law heard in a federal court. See Willingham v. Morgan, 395 U.S. 402, 406-07 (1969). 6. A federal defendant removing under Section 1442 must demonstrate three things: that it is a “person” within the meaning of the statute; that there is a “causal nexus” between its actions and plaintiffs claims; and that it can assert a “colorable federal defense.” Durham, 445 F.3d at 1251. Here, Federal Defendant has met the three-part test for removal set forth in Durham. Moreover, with respect to the third requirement, “colorable” is interpreted broadly. Jefferson County, Ala. v. Any action brought in a State court to Which the Postal Service is a party may be removed to the appropriate United States district court under the provisions 0f chapter 89 of title 28.”). 8. Pursuant t0 Civil L.R. 3-2(c) and Civil L.R. 3-2(d), assignment t0 the San Jose Division of the United States District Court for the Northern District of California is proper, since a substantial part 0f the events took place in the County 0f Santa Clara. 9.
