AR DATE: September 12, 201 9 RE: People vs Ukyo Duong CASE NUMBER: 19AP002524 Dear Sir or Madam: The traffic appeal should not be dismissed for lack of appellate jurisdiction for two reasons: (1) I cannot be held responsible for the trial court clerk incorrect marking, (2) It shall not be considered late when | replied / responded prior to the closing of the business day within the allowed number of days. | called and talked over the phone with the trial court clerk 3 hours before the deadline as told by her. She said if someone (witness) that know could serve / mailed in the letter and | came into the court prior to 2:30pm to give her the appeal letter, on that same day that | spoke with her then | am not late. I followed and executed the instruction as given by the clerk. Now, for the matter that the clerk wrongly marked it or not gave the correction instructions is not my fault. Also, the instructions on the appealing letter does not explain in the details about all the process of how the paperwork is transferred our routed within the departments. It only instructs that it has to be replied within a certain number of days. I cannot be held responsibIe if the details were not explained to me. In fact I am surprised to receive this letter telling me thatl am late. The main reason about why it was sent out in the last minutes is that the instructions in the appealing letter are written in such a way that it’s very difficult to understand. I had to bring it around to ask a least a few people to see if | understand it correctly. As a result, I misplaced the letter. I kept looking for it and finally | found it. I called the trial court clerk immediately to check if I could still appeal. That’s how she instructed me to get everything done, and saw her by 2:30pm in order to make it.
