At all times relevant herein,20 plaintiff was insured for personal property loss at her home by defendant GEICO as named21 22 23 herein. [2] At all times relevant herein, defendant GEICO INSURANCE AGENCY, INC. ("defendant GEICO") is and was a corporation, organized and/or existing under the laws of the24 State ofCdifomia and/or is or was authorized to transact, and were and are transacting, business in25 the State ofCalifornia as an insurer.26 27 [3] At all times relevant herein, plaintiff Nakano was the insured beneficiary of defendant GEICO under a "Homesite Insurance Company of California" insurance policy No.28 E-FILED 5/11/2018 3:08 PM Clerk of Court Superior Court of CA, County of Santa Clara 18CV328177 Reviewed By: E. Fang 18CV328177 32886298, a true and correct copy ofwhich is attached as Exhibit 1 and incorporated herein. [4] The true names and capacities, whether individual, corporate, associate or otherwise of defendants Does 1 through 100, inclusive, are unknown to plaintiffat this time, who therefore sues4 said defendants by such fictitious names and when the true names and capacities of such defendants have been ascertained, willamend this Complaint accordingly. 6 [5] Plaintiff is informed and believes, and thereupon alleges, that each defendant designated herein as a Doe is responsible, negligently or in some manner, for the acts, facts, events, representatives and happenings hereinafter referred to, and caused injuries and damages proximately thereby to plaintif as hereinafter alleged, whether through said defendants'wn intentional, 10 negligent, fraudulent or other conduct or through the conduct of its agents, servants or employees, 11 or in some other manner. Plaintiffis informed and believes, and thereupon alleges, that at all times 12 stated herein defendants, and each of them, were the agents, servants, employees and/or joint 13 venturers of their co-defendants and were as such acting within the scope, course and authority of 14 such agency, employment and/or joint venture, and that each and every defendant, as aforesaid, 15 when acting as a principal, was negligent in the selection and hiring of each and every other 16 defendant as agent, servant, employee and/or joint venturer. 17 / 18 19 20 GENERALALLEGATIONS [6] PlaintiffNakano has had defendant GEICO insurance coverage when she suffered a covered loss to human hair eyelashes, imported from the Far East. [7] At all times herein mentioned, plaintiffNakano was informed by defendant GEICO 21 that plaintiffwas the insured beneficiary, through defendant GEICO, of the Homesite Insurance 22 Company of California policy of insurance coverage that pays for the loss to the human hair eye 23 lashes. The subject insurance policy is attached hereto at Exhibit1. 24 [8] Implied in said insurance policy is a covenant by defendants that they would act in 25 good faith and fair dealing with the insured and that said defendants, and each of them, would not 26 do anything to interfere with the rights of the insured to receive the benefits of the insurance 27 agreements. 28 [9] The above-said GEICO-Homesite insurance policy was in full force and effect and ! all of the coverage set forth hereinabove became due and payable when plaintiffNakano suffered a covered loss. A claim was opened and remains open at this time -yet has never been paid. [10] Plmntiff Nakano tendered the loss to defendant GEICO, who has never rendered a4 coverage opinion on the claim upon the insurance policy. [11] As a result thereof, plaintiffNakano has swered loss of the human hair eye lashes, and 6 willsuffer additional damages, covered under the subject insurance policy. 7 [12] At all times relevant herein, defendants, and each of them, knew that plaintiffwas 10 entitled to recover for the claim and losses suffered, but said defendant GEICO refused to negotiate or settle the matter in a fair manner with plaintiff [13] Defendant GEICO did not properly provide insurance coverage for plaintift's human 11 hair eye lashes, negligently or intentionally, ancVor falsely represented the coverage or defendant 12 GEICO has improperly denied plaintiff's claim by not rendering a coverage opinion. 13 [14] In fact, in failing to act on plaintiffs claim and loss, defendant GEICO knew that they 14 ~ owed plaintiffthe benefits therefrom. The denial of the claim by inaction was unjust and imposes a 15 cruel hardship upon this fail, single woman. 16 [15] The above acts and omissions were all done for the purpose of, inter alia, compelling 17 plaintiffNakano to abandon her claim and absorb the loss herself, during which time defendants 18 would retain use of the tnoney owed. Defendant GEICO and each and every other defendant, and 19 each of them, in breach of their covenant of good faith and fair dealing, intentionally, maliciously 20 and oppressively refused and failed to pay plaintiffNakano in accordance with the terms of the 21 policy. 22 [16] Because plaintilFNakano is a fail, single woman, she has suffered extreme general and 23 special damages. 24 [17] As a direct and proximate result of each and every defendants'rongful conduct as 25 herein alleged, plaintiffNakano is now compelled to pursue this claim and loss by way of, inter alia, 26 this Complaint and in connection herewith to incur costs ofsuit, according to proof. 27 [18] Each of the acts hereinabove was done through, or with the knowledge of each and 28 every other defendant. In fact, by the acts, facts and events complained of herein, plaintiffNakano is informed and believes that defendants, and each of them, conspired through an illegal and undisclosed business scheme to deny the claim and loss as alleged herein. [19] As a further direct proximate result of each and every defendants'rongful conduct as herein alleged, plaintiffhas suffered loss ofuse ofmoney owed by defendant GEICO Irom the date the claim should have been paid, in excess of the jurisdictional minimum ofthis Court. 8 10 12 13 14 15 16 17 19 20 21 22 23 24 25 26 27 28 FIRST CAUSE OF ACTION (Breach ofContract) [20] Plaintiffby this reference incorporates paragraphs 1 through 19, inclusive, as iffully set forth herein. [21] The written promises as set forth in the attached Exhibit 1 subject insurance policy caused to be issued by defendants, and each of them, and the subject policies, formed a written agreement between plaintiffand each and every defendant. [22] Plaintiffhas performed all conditions, covenants and promises required by her on her part to be performed in accordance with the terms and conditions of the contract. [23] Plaintiffhas requested that each and every defendant perform their obligations under the subject insurance. [24] Defendants have breached the contract by failing to provide coverage to plaintiff Nakano. [25] As a result of each and eve defendants'reach of the contract, plaintiffhas suffered I general and special damages, including medical expenses, attorney's fees and costs of suit, in sums according to proof, but in excess ofthe minimum jurisdictional 1 units of this Court. WHEREFORE, plaintiffprays judgment against defendants, and each of them, as further set forth below. SECOND CAUSE OF ACTION (Fraud) [26] Plaintiffby this reference incorporate paragraphs I through 25, inclusive, as iffullyset forth herein. [27] By the provisions of the written subject insurance policy agreement, each and every defendant represented to plaintiffNakano, that ifsaid plaintiffcomplied with all the terms and2 conditions of the subject insurance policy, said defendants would pay, or cause to be paid, to plaintiffor on plaintiffs behalf the amount of the claim and loss. Plaintiffduly complied with all the terms and conditions of the policies on her part. 5 [28] Each and every defendants'bove-stated representations and agreements, and theI 6 policy itself, were and remain false and fraudulent, in that defendants, and each of them, never 7 intended to pay, or cause to be paid, plaintiffs claim and loss, but instead have a fixed and firm I8 policy of contesting all losses where it could not negotiate a settlement for a sum ofmoney which 9 was substantially less than that required to make plaintiffwhole under the terms of the policy, as 10 well as the written representations. At the time defendants, and each of them, entered into the 11 insurance connacts for plaintiffs benefit, said defendants willfullyconcealed the above facts, all for 12 the purpose ofdefrauding and deceiving plaintiffand inducing the purchase of the policy. 13 [29] The representations, as aforesaid, and the policy issued by defendants, and each of 14 them, were in fact false. 15 [30] As a proximate result of said defendants'raud and deceit and the facts herein alleged, 16 plaintiffhas been induced to expend money on medical expenses, hours of time and energy in an 17 attempt to receive coverage under the subject insurance contract, as well as to incur attorney's fees 18 and costs ofsuit. 19 [31] PlaintiffNakano is entitled to recovery for general and special damffgcs as according 20 to proof. 21 [32] The aforementioned conduct of defendants, and each of them, formed an intentional 22 misrepresentation, deceit or concealment of material facts known to said defendants with the 23 intention on the part of said defendants to deprive plaintiffof property or legal rights, or otherwise 24 causing injury, and was despicable conduct that subjected plaintiffto a cruel and unjust hardship in gd a i dia egatri f pi 'ifF 'gttta, t j tify m a md f x mptmy d p itic 26 damages. 27 WHEREFORE, plaintiffprays judgment against defendants, and each ofthem, as further set 28 forth below. THIRD CAUSE OF ACTION (Breach ofCovenant ofGood Faith and Fair Dealing) [33] Plaintiffby this reference incorporates paragraphs 1 through 32, inclusive, as iffully set forth herein. 7, 10 [34] Implied in all contracts of insurance within the State of California is the covenant of good faith and fair dealing [35] At all times relevant herein, defendants, and each of them, knew that plaintiffNakano was entitled to recover her claim for damages in the amount of the loss but each and every defendant refused to negotiate or settle the matter in a fair manner with plaint iffNakano. [36] For the sole purpose of compelling plaintiffNakano to whether abandon her claim or to force plaintiffto accept a lesser sum in settlement of her claim, or ifthey persisted in seeking more to incur substantial detriinent, delay and additional expenditures in pursuing enforcement of their claim, all during which time each and every defendant would retain use of the money, said defendants, in breach of their covenant ofgood faith and fair dealing, intentionally, maliciously and 15 oppressively refused and failed to pay in accordance with the terms of the policy. [37] As a direct and proximate result of each and every defendants'rongful conduct as 17 herein alleged, plaintiff was compelled to present her claim by way of this Complaint, and in 18 connection herewith, to incur attorney's fees and costs of suit according to proof. 19 [38] As a further direct proximate result of each and every defendants'rongful conduct as 20 herein alleged, plaintiff has suffered loss of use of money owed to them by each and every 21 defendant from the date the claim should have been paid to him, all in excess of the minimum 22 jurisdictional limits of this Court. 23 [39] As a further direct and proximate result of each and every defendants'rongful [ ] gfll g and was malicious, oppressive and lraudulent in nature, and plaintiffis therefore entitled to recover28 conduct as herein alleged, plaintiff has sustained emotional and mental distress, anguish,24 embarrassment, mortification, humiliation and indignity, all to her general damage and medical25 expenses, attorney's fees and costs of suit in a sum according to proof.26 40 Each and eve defendants'ron I conduct as herein alle ed was done intentionally punitive damages/exemplary damages according to proof. 2 WHEREFORE, plaintiffNakano prays judgment against defendants, and each of them, as 3 further set forth below. FOURTH CAUSE OF ACTION (Negligence) [41] Plaintiffby this reference incorporates paragraphs 1 through 40, inclusive, as iffully6 set forth herein. 7 [42] At all times relevant herein each and every defendant owed plaintiffNakano a general8 duty of due care. [43] At all times relevant herein, and within the applicable two-year statute of limitations10 for damages arising Irom negligence causing personal injury, each and every defendant breached11 their general duty ofdue care owed to plaintiff. 12 [44] As a proximate result of the negligence of each and every defendant, plaintiffNakano13 has suffered damages to by, inter alia, not being able to obtain critical business insurance benefits,14 by not being able to replace damaged property. 15 [45] As such, plaintiff has otherwise been hurt and injured in her health, strength and16 activity, sustaining injury to her nervous system and person, all of which injuries have caused, and17 continue to cause, plaintiffgreat mental, physical and nervous pain and suffering. As a result of18 such injuries, plaintiffNakano has suffered general and special damages in amounts according to19 proof. 20 WHEREFORE, plaintiffNakano prays judgment against defendants, and each of them, as21 further set forth below. 22 23 FIFTH CAUSE OF ACTION [ViolationofInsurance Code Section 790.03(h), et seq.]24 [46] Plaintiffby this reference incorporates paragraphs I through 48, inclusive, as iffully25 set forth herein. 26 [47] At all times relevant herein each and every defendant owed plaintiffa duty ofdue care27 not to violate the terms and conditions ofInsurance Code Section 790.03(h), et seq.28 I [48] At all times relevant herein, each and every defendant breached their duties to plaintiff as set forth herein. 3 [49] As a proximate restdt of the breaches of each and every defendant, plaintiff has ' suffered damages to by, inter alia, not being able to obtain critical business insurance benefits, by not being able to replace damaged personal property. 6 [50] As such, plaintiffNakano has otherwise been hurt and injured in her health, strength 7 and activity, sustaining injury to her nervous system and person, all of which injuries have caused, 8 and continue to cause, plaintiffgreat mental, physical and nervous pain and suffering. 9 As a further result of such injuries, plaintiffIrene Nakano has suffered general and special 10 damages, as well as incurred attorney's fees and costs ofsuit, in amounts according to proof. 11 WHEREFORE, plaintiffprays judgment against each and every defendant as follows: 12 I.
