Both grounds fail. First, Plaintiffs argue that the costs were not identified. Plaintiffs note that “while supporting documentation is not required to be filed with the cost memorandum, once an item is properly objected to and put at issue, the burden of proof shifts to the party claiming it as cost to show that it is reasonable and necessary.” Plts.” Mot. at 5 (citing Ladas v. Cal. St. Auto. Ass’n, 19 Cal. App. 4th 761 (1993)). Defendants have met their burden through the Declaration of Robert L. Dell Angelo, which itemizes each cost incurred. The costs are all recoverable and consist of: (i) first appearance fees for the multiple derivative actions Plaintiffs filed in the Court’s complex division before consolidation; and (i1) filing fees for motion practice. These costs are recoverable because each defendant was required to pay the fee. See Townzen v. County of El Dorado, 64 Cal. App. 4th 1350, 1352, 1357- 58 (1998) (holding that 11 separately named defendants were each entitled to recover as costs their first appearance fees, even though they filed joint legal briefs, because the law requires that each defendant pay the first appearance fee); see also G.R. v. Intelligator, 185 Cal. App. 4th 606, 620 (2010) (rejecting argument that first appearance fees are not recoverable as costs); Slavin v. Fink, 25 Cal. App. 4th 722, 725 (1994) (affirming award of first appearance fee as a recoverable cost, while taxing other claimed costs). Second, Plaintiffs argue that the “Court has the power to disallow costs even if allowable as a matter of right, if they were not reasonably necessary.” Plts.” Mot. at 5 (citing Perko’s Enters., Inc. v. RRNS Enters., 4 Cal. App. 4th 238, 244 (1992)). Perko’s is inapposite. In that case, the prevailing defendant incurred costs unnecessarily after it already had prevailed. The plaintiff brought an ex parte application; defense counsel appeared and objected at a hearing on the application and it was denied; and the defendant then filed an opposition to the already- denied application and incurred a filing fee of $415. The court in Perko’s remanded for the trial court to determine whether the filing fee was reasonable and necessary. Here, Defendants’ costs were undoubtedly reasonable and necessary. Defendants were required to pay first appearance fees.
