William Viray, on his own behalf and on behalf of Natividad Navarro Viray, deceased, (hereinafter “Plaintiffs”) filed a Plaintiffs Claim and ORDER to Go to Small Claims Court (“Complaint”) on December 5, 2017 in the Santa Clara County Superior Court against Defendant. Though the Complaint allegations are not entirely clear, William Viray alleges that an incident occurred in August of 2009 relating to “unconsented two documents that have scribble lines,” rather an “real signatures.” He demands lost wages, is “demanding of the death of my grandmother,” and “demanding of violation rights and privacy.” He also demands that unspecified persons “should be in prison, lifetime.” He is also “demanding to clear [his] medical record.” Plaintiff demands in excess of $10,000. The Complaint names as defendants the United States Postal Service, Kaiser Permanente, and Stephen Meritt Raffle. 2. On or about December 8, 2017, the United States Attorney’s Office received a copy of the Complaint from the United States Postal Service. The United States Attorney’s Office has not been served with a copy of the Complaint pursuant to Fed. R. CiV. P. Rule 4(1)(1)(A). A copy of the Complaint, including its attachments, is attached hereto as Exhibit A. This constitutes the only process or pleading which has been received to date. A Small Claims Court trial has been scheduled for January 30, 2018. 3. All pending coutt dates in Santa Clara County Superior Court should be automatically vacated upon the filing of this Notice of Removal. 4. Removal of this action to the United States District Court is made pursuant to 28 U.S.C. § 144] (a) and (6) because Plaintiffs seek monetary damages from the United States of America. It is removable to this Court pursuant to 28 U.S.C. §§ 1441(a) and 1442(a)(1) because it is a civil action against an agency ofthe United States.
