DISCOVERY COMPLETED TO DATE/OUTSTANDING DISCOVERY: Pursuant to a discovery conference with Special Master, Sarah Burke, the Parties stipulated t0 an amended discovery timeline t0 Case Management Order N0. 1 (“CMO”) Which was entered as an order of the Court 0n January 2, 2020. At the recommendation of Sarah Burke, the trial date has been continued t0 September 28, 2020. A. Discovery Completed: Expert investigations including inspections and testing in the common areas and integrally related components as well as exchange 0f preliminary expert reports and repair estimates are continuing. Viracon conducted Visual inspections of Windows on January 27-28 and intend t0 remove Windows for laboratory testing the week 0f February 10-14. Designations 0fpersons most qualified (PMQ) were submitted by the Parties on January 10, 2020. The Parties are currently working on a proposed PMQ deposition schedule. Additionally, Plaintiff and Cross-Defendant BrassCraft successfully engaged in settlement negotiations, contingent upon approval of a good faith settlement motion. Cross-Defendant, ACCO Engineering filed an opposition t0 said Motion which is scheduled t0 be heard by the Court 0n February 14, 2020. B. Outstanding Discoverv: Plaintiff’ s Final Expert Reports are due on February 10, 2020. Due to the ongoing Window investigation being conducted by Viracon, Plaintiff Will seek leave 0f the Special Master for a brief continuance 0f this deadline during the conference call scheduled for February 6. Initial and supplemental expert witness disclosures Which shall include deposition dates are scheduled for March 23 and April 6, 2020 respectively. Expert Witness depositions Will commence with Plaintiff’s experts 0n May 4, 2020. A11 depositions are to be completed by August 14, 2020. 2. FACTUAL AND LEGAL ISSUES: This is a construction defect action governed by the provisions 0f Civil Code Sections 895 et seq.
