Schenkier DEFENDANT’S MOTION TO STAY Defendant Power Solutions International, Inc. (“PSI”) moves to stay this case to protect competing interests arising from this case and a criminal Indictment involving overlapping subject matter, captioned United States v. Winemaster, et al., Case No. 1:19-cr-00587, filed on July 18, 2019 in the U.S. District Court for the Northern District of Illinois. In support, PSI states: 1. This Court has inherent power in its discretion to stay this case as justice requires until the criminal proceeding is completed. Brunder Corp. v. Balogh, 819 F. Supp. 811, 813 (E.D. Wis. 1993). A complete stay pending the conclusion of the criminal proceeding is necessary to allow PSI to defend itself in this action and to preclude Plaintiff from unfairly benefiting from the criminal charges brought against Winemaster and involving other witnesses in this case. 2. In support of this Motion, PSI refers the Court to its contemporaneously-filed Memorandum of Law and Exhibits, which PSI incorporates as if fully stated herein. DeRosa, discussed this Motion by telephone conference on July 25, 2019 with Plaintiff’s counsel, Tim Coley and Nancy Turner. Plaintiff opposes this Motion. WHEREFORE, Defendant Power Solutions International, Inc. respectfully requests the Court stay this case until the overlapping criminal proceeding is concluded, and grant such other relief as the Court deems just and proper.
