(collectively “Sun”) moves this Court to enforce the Settlement Agreement entered into between Amgen, Inc. and Sun to resolve Civil Action No. 1:16-cv-882, which was consolidated with and into C.A. No. 16-cv-853-MSG CONSOLIDATED. Specifically, as detailed in the accompanying confidential memorandum, Sun requests an evidentiary hearing following targeted discovery to establish certain rights and privileges to Sun under the Settlement Agreement between Amgen and Sun. Under that Settlement Agreement, this Court retained jurisdiction to resolve the instant dispute. For the reasons set forth in the accompanying memorandum, Sun requests an Order permitting the limited discovery outlined therein and setting an evidentiary hearing to further prevent the injury occurring to Sun.
