No. 15-1158 (LPS) (CJB) PLAINTIFF’S MOTION TO EXCLUDE EXPERT TESTIMONY Plaintiff The Gillette Company LLC (“Gillette”) moves pursuant to Rule 702 of the Federal Rules of Evidence and Daubert v. Merrell Dow Pharm., Inc., 509 U.S. 579 (1993), to exclude certain opinion testimony of Defendants’ experts, Dr. Richard Haber, Mr. James E. Malackowski, and Mr. Donald J. Bray. With respect to Defendants’ non-infringement expert, Dr. Richard Haber, Gillette requests that the Court exclude: (1) his infringement opinions that are based on an erroneous claim construction that requires the “overcoat layer” to have a different chemical composition than the “hard coating” layer, or to be deposited under different conditions; and (2) his opinions comparing the Accused Products, and processes for making those products, with Gillette’s commercial embodiments of the ʼ513 Patent and processes for making those products. With respect to Defendants’ damages expert, Mr. James Malackowski, Gillette requests that the Court exclude: (1) his reasonably royalty opinions based on purportedly comparable licenses; (2) his opinions on non-infringing alternatives; (3) his “apportionment” opinion that Gillette is entitled to only 10% or less of its lost profits; and (4) his technical opinions regarding the relationship of blade characteristics to the patented inventions.
