No. 15-1158 (LPS) (CJB) PLAINTIFF’S MOTION FOR PARTIAL SUMMARY JUDGMENT Plaintiff The Gillette Company LLC moves pursuant to Rule 56 of the Federal Rules of Civil Procedure for partial summary judgment on the following three issues. First, Gillette requests that the Court grant summary judgment in favor of Gillette with respect to Defendants’ invalidity claims and defenses based on certain experimental testing performed by Gillette in 1995. Second, Gillette requests that the Court grant summary judgment that the conception date for claims 1, 2, 15, 16, and 20 of the ʼ513 Patent is no later than February 1998. Third, Gillette requests that the Court grant summary judgment in favor of Gillette on Defendants’ non-infringement claims and defenses to the extent they rely on an erroneous claim construction that requires the “overcoat layer” to have a different chemical composition than the “hard coating” layer, or to be deposited under different conditions. The grounds for Gillette’s motion are set forth in Plaintiff’s Opening Brief in Support of Its Combined Motions for Partial Summary Judgment and to Exclude Expert Testimony and accompanying declaration and exhibits, filed concurrently herewith.
