No. 15-1158-LPS-CJB DEFENDANTS’ MOTION FOR SUMMARY JUDGMENT OF INVALIDITY Pursuant to Federal Rule of Civil Procedure 56(a), Dorco Company Ltd., Pace Shave, Inc., and Dollar Shave Club, Inc. (collectively, “Defendants”) respectfully move for summary judgment that all asserted claims of U.S. Patent No. 6,684,513 are invalid under 35 U.S.C. § 102(b). In the alternative, Defendants move for partial summary judgment and request the Court find either (a) there was at least one public use under 35 U.S.C. § 102(b) of a razor blade during the OW-006 and OW-007 tests; or (b) the experimental use exception does not apply to uses of razor blades during the OW-006 and OW-007 tests. The grounds for this motion are set forth in Defendants’ Opening Brief in Support of Their Motion for Summary Judgment of Invalidity. WHEREFORE, Defendants respectfully request that the Court enter the attached order granting this motion.
