Prior to our deciding whether to institute an inter partes review, the
parties filed a Joint Motion to Terminate the Proceeding (Paper 8) pursuant
to a settlement agreement, which requests that the settlement agreement
(Paper 9) be treated as business confidential information, kept separate from
the file of the involved patent, and made available only as proscribed under
37 C.F.R. § 42.74(c).
Accordingly, it is
ORDERED that the proceeding is terminated; and
FURTHER ORDERED that the settlement agreement (Paper 9)
be treated as business confidential information, kept separate from the file of
U.S. Patent No. 8,280,278 B2, and made available only to Federal
Government agencies on written request, or to any person on a showing of
good cause, under the provisions 37 C.F.R. § 42.74(c).
