Nov. 24, 2014) Copy Citation Baltimore, MD UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD YOUR PUBLIC RADIO CORPORATION Employer and SCREEN ACTORS GUILD-AMERICAN FEDERATION OF TELEVISION AND RADIO ARTISTS, WASHINGTON-MID ATLANTIC LOCAL, AFL-CIO Petitioner Case 05-RC-130206 DECISION AND DIRECTION The National Labor Relations Board has considered challenged ballots and objection in an election held July 30, 2014, and the hearing officer's report recommending disposition of them. The election was conducted pursuant to a Decision and Direction of Election. The tally of ballots shows 9 ballots cast for and 11 ballots cast against the Petitioner, with 1 void ballot and 7 challenged ballots, a sufficient number to affect the results.1 No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations.2 1 Four of the challenged ballots were resolved by the parties. 2 The Hearing Officer recommended sustaining the challenges to the voting eligibility of Sheilah Kast, and Daniel Rodricks because both are supervisors with the meaning of Section 2(11) of the Act. He further recommended that the Petitioner’s challenge to Kyle Leslie’s voting eligibility be overruled in its entirety, because Leslie is neither a supervisor nor a manager. The Hearing Officer also recommended that the Petitioner’s lone objection should be overruled because the evidence is insufficient to show that the Employer engaged in objectionable conduct. DIRECTION IT IS DIRECTED that the Regional Director for Region 5 shall, within 14 days of this direction, open and count the ballot of Kyle Leslie, and thereafter prepare and serve on the parties a revised tally of ballots, and issue the appropriate certification.
