SUPPLEMENTAL DECISION
AND
ORDER

On December 23, 1938, the National Labor Relations Board, herein
called the Board, issued a Decision and'Direction of Election 1 in
the above-entitled matter. On January 7, 1939, the Board issued
an Amendment to the Direction of Election.2 The Direction of
Election, as amended, directed that an election by secret ballot be
conducted within thirty (30) days from the date of the Direction
issued on December 23, 1938, among employees of Yates-American
Machine Company, Beloit, Wisconsin, to determine whether they
desired to be represented by International Association' of Machinists,
Local 1139, by Steel Workers Organizing Committee on behalf of
the Amalgamated Association of Iron, Steel and Tin Workers of
North America, Lodge 1787, for the purposes of collective bargain-
ing, or by neither. On January 20, 1939, the Board issued a Second
Amendment to Direction of Election 8 postponing the holding of
the election until such time as the Board might in the future direct..
On July 31, 1939, Steel Workers Organizing Committee on behalf
of the Amalgamated Association of Iron, Steel and Tin Workers of
North America, Lodge 1787, filed with the Board a petition request-
ing that its name be removed from the ballot of any election that
might be conducted in the present proceeding.
International 'Association of Machinists, Local 1139; the organiza-
tion which filed .the petition for investigation and certification of
representatives and the only other organization involved, by letter
dated September 17, 1939, requested permission to withdraw, with-
out prejudice, its petition for investigation and certification of
representatives.

By virtue of Section 9 (c) of the National Labor Relations Act,
49 Stat. 449, and pursuant to Article III, Section 8, of National
Labor Relations Board Rules and Regulations- Series 2,
IT IS HERESY ORDERED that the request of International Association
of Machinists, Local .1139, for permission to withdraw its petition
for investigation and certification of representatives, without preju-
dice, be, and it hereby is, granted; that the Direction of Election, as
amended, hereinbefore issued be, and it hereby is, vacated; and that
the aforesaid case be, and it hereby is, closed.
MR. WILLIAM M. LEISERsoN took no part in the consideration of
the above Supplemental Decision and Order.
