I. O. Cases Nos. R-1.035 and R-4036, respectively SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES September 16,, 1942 On August 6, 1942, the National Labor Relations Board issued a Decision and Direction of Elections in the above-entitled proceeding. Pursuant to the Direction of Elections, elections by secret ballot were conducted on August 25 and 27, 1942, under the direction and supervi- sion of the Regional Director for the Thirteenth Region (Chicago, Illinois). On August 28, 1942, the Regional Director, acting pursuant to Article III; Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballots or to the Election Report have been filed by any of the parties. Upon the entire record in the case, the Board makes the, following SUPPLEMENTAL FINDINGS OF FACT We find that all bricklayers, bricklayer apprentices, and -Ni,orking bricklayer foremen employed by the Company at its Wisconsin Steel Works, constitute a unit appropriate for the purposes-of collective bargaining within the meaning of Section 9 (b) of the Act. We also find that all production and maintenance employees 'em- ployed by the Company at its,Wisconsin Steel Works including brick- layer helpers but excluding supervisory and managerial employees,, confidenthil employees, plant) protection employees, plant 'clerical employees, office clerical employees, bricklayers, bricklayer apprentices,. and working bricklayer foremen, constitute a unit appropriate for the -purposes of collective bargaining, within the meaning of Section 9 (b) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations At, 49-'Stat. 449, and pursuant to Article III, Sections 8 and 9; of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HLREI3Y CERTIFIED that Bricklayers, Masons & Plasterers Inter- national Union of America, Local 21 of Illinois, affiliated"" with- the- An7erican Federation of Labor, has been designated and selected by a majority of all bricklayers, bricklayer apprentices, and working brick- WISCONSIN STEEL WORKS 67 layer foremen, employed by Wisconsin Steel Works, International Harvester Company, Chicago, Illinois, as their representative for the purposes of collective bargaining and that pursuant to Section 9 (a) of the National Labor Relations Act, Bricklayers, Masons & Plasterers International Union of America, Local 21 of Illinois, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes. of collective bargaining with respect to rates of pay, wages, hours of employment, and other condi- tions of_ employment. IT IS FURTHER CERTIFIED that Progressive Steel Workers Union, unaffiliated, has been designated and selected by a 'majority of all production and maintenance employees employed by Wisconsin Steel Works, International Harvester Company, Chicago, Illinois, including bricklayer helpers but excluding supervisory and managerial em- ployees, confidential employees, plant protection employees, plant clerical -employees, office clerical employees, bricklayers,, bricklayer apprentices, and working 'brickayer foremen, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Progressive Steel Workers Union, unaffiliated, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates, of pay, wages, hours of employment, and other conditions of employment.'
