R-1315, R-1316, and R-1317, respectively SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES December 5, 1939 On October 30, 1939, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Elections in the above-entitled proceedings., Pursuant to the Direction of Elections, elections by secret ballot were conducted on November 16 and 17, 1939, under the direction and supervision of the Regional Director for the Nineteenth Region (Seattle, Washington). On November 20, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon the parties an Election Report on the elections. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. The Board stated therein with respect to the election among the boommen, rafters, and slipmen "If, in this election, a majority of the boommen, rafters, and slipmen cast their votes for I. W. A. Local 107, we shall find that they constitute an appro- priate unit and certify I. W. A. Local 107 as exclusive representative thereof." And with respect to the elections (1) among the con- ductors and brakemen and (2) among the firemen and engineers, the Board stated "If the trainmen should receive a majority of the votes cast by the conductors and brakemen, we shall find that they constitute an appropriate unit and certify the Trainmen as exclusive representative thereof. Similarly, if a majority of the firemen and engineers should designate the Firemen as their representative, we shall find that they constitute, an appropriate unit and certify the Firemen as exclusive representative thereof." WEYERHAEUSER TIMBER COMPANY 131 Upon the entire record in the case, the Board makes the following: SUPPLEMENTAL FINDINGS OF FACT We find that all the boommen, rafters, and slipmen employed by the Weyerhaeuser Timber Company at its Longview Branch, Longview, Washington, at the mill pond, falling within the classifi- cations of pondmen, sorters, head raftsmen, log unloaders, slipmen, or any other such classifications, constitute a unit appropriate for the purposes of collective bargaining, and that said unit will insure to the employees of the Company the full benefit of their right to self- organization and to collective bargaining and otherwise effectuate the policies of the Act. We find that all conductors and brakemen employed by the Weyer- haeuser Timber. Company at its Longview Branch, Longview, Wash- ington, on the logging trains, constitute a unit appropriate for the purposes of collective bargaining, and that said unit will insure to employees of the Company the full benefit of their right to self- organization and to collective bargaining and otherwise effectuate the policies of the Act. We find that all firemen and engineers employed by the Weyer- haeuser Timber Company at its Longview Branch, Longview, Wash- ington, on the logging trains, constitute a unit appropriate for the purposes of collective bargaining, and that said unit will insure to employees of the Company the full benefit of their right to self- organization and to collective bargaining and otherwise effectuate the policies of the Act. Upon the basis of the above findings of fact and upon the entire record in the case, the Board makes the following: SUPPLEMENTAL CONCLUSIONS OF LAW The employees engaged as boommen, rafters, and slipmen by the Weyerhaeuser Timber Company at its Longview Branch, Long- view, Washington, at the mill pond, falling within the classifications of pondmen, sorters, head raftsmen, log unloaders, slipmen, or any other such classifications, constitute a unit appropriate for the pur- poses of collective bargaining within the meaning of Section 9 (b) of the National Labor Relations Act. The employees engaged as conductors and brakemen by the Weyer- haeuser Timber Company at its Longview Branch, Longview, Wash- ington, on the logging trains constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the National Labor Relations Act. The employees engaged as firemen and engineers by the Weyer- haeuser Timber Company at its Longview Branch, Longview, Wash- 132 DECISIONS OF NATIONAL LABOR RELATIONS BOARD ington, on the logging trains constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the National Labor Relations Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National La- bor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9 of Na- tional Labor Relations Board Rules and Regulations-Series 2, IT IS HEREBY CERTIFIED that International Woodworkers of Amer- ica, Local No. 107, Boommen and Rafters, has bean designated and selected by a majority of the boommen, rafters, and slipmen em- ployed by the Weyerhaeuser Timber Company at its Longview Branch, Longview, Washington, at the mill pond, falling within the classifications of pondmen, sorters, head raftsmen, log unloaders, slip- men, or any other such classifications, as their representative for the purposes of collective bargaining, and that pursuant to Section 9 (a) of the Act, International Woodworkers of America, Local No. 107, Boommen and Rafters, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of -employment, and other conditions of employment. IT IS HEREBY CERTIFIED that the Brotherhood' of Railroad Trainmen has been designated and selected by a majority of the conductors and brakemen employed by the Weyerhaeuser Timber Company at its Longview Branch, Longview, Washington, on the logging trains, as their representative for the purposes of collective bargaining, and that pursuant to Section 9 (a) of the Act, Brotherhood of Railroad Trainmen is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment. IT IS HEREBY CERTIFIED that Brotherhood of Locomotive Firemen and Enginemen has been designated and selected by a majority of the firemen and engineers employed by the Weyerhaeuser Timber Company at its Longview Branch, Longview, Washington, on the logging trains, as their representative for the purposes of collective bargaining, and that pursuant to Section 9 (a) of the Act, Brother- hood of Locomotive Firemen and Enginemen is the exclusive rep- resentative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
