OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by the American Federation of Radio Artists, affiliated with the American Federation of Labor, herein called the A F of L , alleging that a question affcctuig commerce had arisen concerning representation of employees of the Westing- house Radio Stations, Inc, herein called the Company, engaged in Pittsburgh, Pennsylvania, in commercial broadcasting, the National Labor Relations Board provided for an appropriate hearing upon due notice On June 30, 1942, before a hearing was held, the Com- pany, the A F. of L, and the Regional Director for the Sixth Region (Pittsburgh, Pennsylvania), entered into a "Stipulation for Certifi- cation Upon Pay-roll Check " ' Pursuant to the stipulation, a pay-roll check was conducted on June 22, 1942, under the direction and supervision of the Regional Director among all staff announcers of the Company located at radio station KDKA, Pittsburgh, Pennsylvania, to determine whether or not they desired to be represented by the A. F. of L. for the purposes of collective bargaining On July 23, 1942, the Regional Director issued and duly served upon the parties a Report on Results of Investigation and Inspection of Records. No objections to the Re- port have been filed by any of the parties 42 N L R B, No 249 ' ' 1373 1374 DECISIONS OF NATIONAL LABOR RELATIONS BOARD As to the investigation and its results, the Regional Director reported as follows The comparison of the application-for-membership cards of the Union with the pay roll of the Company as of June 27, 1942, showed that 8 of the 8 eligible employees designated the Union to, represent them as their collective bargaining representative. Upon the basis of the stipulation, the 'Report and the entire record in the case, the Board makes the following. FINDINGS of FACT 1 A question affecting conmleice has arisen concerning the repre- sentation of the employees of' Westinghouse Radio Stations, Inc, Pittsburgh, Pennsylvania, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act 2 All staff announcers employed by the Company at its radio station KDKA, Pittsburgh, Pennsylvania, constitute a unit appro- priate ;for. the purposes of collective bargaining within the meaning of Section 9((b) of the^Act 3 American Federation of Radio Artists, affiliated with the Amer- ican Federation of Labor, has been designated and relected by a majority of the employees in the above unit as their representative for the purposes of collective bargaining and is the exclusive repre- sentative of all employees in the said unit within the meaning of Section 9 (a) of the Act.
