Employer and ANNMARIE REID Petitioner and IUE-CWA LOCAL #1140 Union Involved Case 18-RD-109962 DECISION AND DIRECTION The National Labor Relations Board has considered challenged ballots in an election held August 27, 2013, and the Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 8 ballots cast for and 8 ballots cast against the Petitioner, with 2 challenged ballots, a sufficient number to affect the results.1 No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations. 1 The Union challenged the ballot of Travis Jarl on the ground that he is a temporary employee and therefore not eligible to vote in the election. The Regional Director recommended that the Union’s challenge to the ballot of Travis Jarl be sustained and that his ballot not be opened and counted. The Board agent conducting the election challenged the ballot of Michelle Wess because her name does not appear on the Excelsior list. The Regional Director recommended that the ballot of Michelle Wess be opened and counted. 2 DIRECTION IT IS DIRECTED that the Regional Director for Region 18 shall, within 14 days of this direction, open and count the ballot of Michelle Wess, and thereafter prepare and serve on the parties a revised tally of ballots, and issue the appropriate certification.
