Warwick Knitting Mills, Inc. and Beverly Knitting MillDownload PDFNational Labor Relations Board - Board DecisionsMay 11, 193912 N.L.R.B. 830 (N.L.R.B. 1939) Copy Citation In the Matter Of WARWICK KNITTING MILLS, INC., and BEVERLY KNITTING MnL and INTERNATIONAL LADIES' GARMENT WORK S UNION Case No. R-1174 SUPPLEMENTAL DECISION AND ORDER May 11, 1939 On March 6, 1939, the National Labor Relations Board, herein called the Board, issued a Decision, Direction of Election, and Order 1 in the above case .2 On March 18, 1939, the Board issued an Amend- ment to Decision, Direction of Election, and Order.3 The Direction of Election, as amended, directed that an election by secret ballot be conducted within twenty (20) days from the date of the Direction among all the production employees of the Company who were employed during the pay-roll period next preceding January 9, 1939, excluding executives, supervisory and clerical employees, and em- ployees who had since quit or been discharged for cause, to determine whether or not they desired to be represented by International Ladies' Garment Workers Union, Local 236, for the purposes of collective bargaining. Pursuant to the Direction, as amended, an election by secret ballot was conducted on March 24, 1939, at Los Angeles, California, under the direction and supervision of the Regional Director for the Twenty-first Region (Los Angeles, California). On March 25, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued and duly served upon the parties an Intermediate Report upon Secret Ballot. No objections or exceptions to the Inter- mediate Report have been filed by any of the parties. 1 11 N. L. R B. 958. The petition for investigation and certification filed by International Ladies' Garment Workers Union will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY ORDERED that the petition for investigation and certifi- cation of representatives of employees of Warwick Knitting Mills, Inc., Los Angeles, California, filed by International Ladies' Garment Workers Union, be, and it hereby is, dismissed.
