The General Counsel’s request for special permission to appeal from
Administrative Law Judge Arthur J. Amchan’s April 5, 2018 Order Reopening the
Record is granted. On the merits, the appeal is denied. The General Counsel has
failed to establish that the judge abused his discretion in reopening the record to
facilitate making the determinations required by the Board’s remand, regarding
credibility and whether the Respondent discriminated against the Charging Party based
on his protected activity.
