Pursuant to the Direction of Election, an election by secret ballot was conducted on February 4, 1943, under the direction and supervision of the Regional Director for the Twelfth Region (Milwaukee, Wisconsin). On February 12,1943, the Regional Director, acting pursuant to Article III, Section 10, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued (and duly served upon the parties a Report on Ordered Election. No objections to the conduct of the ballot or the Report on Ordered Election have been filed by any of the parties., As to the balloting and its results, the Regional Director reported as follows : Approximate number of eligible voters________________________ 13 Total number of ballots cast ---------------------------------- 14 Total number of ballots challenged___________________________ 1 Total number of void ballots________________________________ 0 Total number of valid votes counted_________________________ 13 Votes cast for District 50, United Mine Workers of America_____ 13 Votes cast against District 50, United Mine Workers of America- 0 In its Decision, the Board found that the storeroom clerk was in- cluded in the bargaining unit covered by a collective bargaining con- tract, and excluded him from the present unit. Thereafter, however, the parties advised the Regional Director that the storeroom clerk was not included in the collective bargaining contract unit. He was permitted to 'vote subject to challenge, and the Regional Director has recommended that he be included in the present unit. Since it appears that the storeroom clerk was not included in the bargaining unit covered by a collective bargaining contract, and since he is engaged 1 46 N. L. R. B. 1107. 47 N. L. It. His ballot does not affect the results of the election. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, and pursuant to Article III, Sections 9 and 10, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that District 50, United Mine Workers of America has been designated and selected by a majority of all time- keepers, production clerks, the storeroom clerk, and gatemen, of Union Carbide and Carbon Corporation, Union Carbide Division, Sault Ste. Marie, Michigan, excluding the assistant storekeeper, the' storeroom attendant, and supervisory and main office employees, as their repre- sentative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, District 50, United Mine Workers of America is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
