Request No. 0520180357 Appeal No. 0120180438 Agency No. 4C-080-0125-17 DECISION ON REQUEST FOR RECONSIDERATION Complainant requested that the Equal Employment Opportunity Commission (EEOC or Commission) reconsider its decision in EEOC Appeal No. 0120180438 (March 9, 2018). EEOC Regulations provide that the Commission may, in its discretion, grant a request to reconsider any previous Commission decision issued pursuant to 29 C.F.R. § 1614.405(a), where the requesting party demonstrates that: (1) the appellate decision involved a clearly erroneous interpretation of material fact or law; or (2) the appellate decision will have a substantial impact on the policies, practices, or operations of the agency. See 29 C.F.R. § 1614.405(c). In his underlying complaint, Complainant alleged that the Agency subjected him to unlawful race, sex, disability, age, and reprisal discrimination when on July 30, 2017, he became aware that management had contacted the Office of Workers’ Compensation Programs (OWCP) concerning the amount of his OWCP payments. In its final decision, the Agency dismissed the complaint, pursuant to 29 C.F.R. § 1614.107(a)(1), for failure to state a claim. On appeal, the Commission affirmed the Agency’s final decision. Specifically, we found that Complainant was attempting to lodge a collateral attack on the OWCP process. 1 This case has been randomly assigned a pseudonym which will replace Complainant’s name when the decision is published to non-parties and the Commission’s website. 0520180357 2 In his request for reconsideration, Complainant reiterates his contention that he’s been subjected to unlawful discrimination. We find, however, that after reviewing the previous decision and the entire record, the Commission finds that the request fails to meet the criteria of 29 C.F.R. §1614.405(c), and it is the decision of the Commission to deny the request. The decision in EEOC Appeal No. 0120180438 remains the Commission's decision. There is no further right of administrative appeal on the decision of the Commission on this request. You have the right to file a civil action in an appropriate United States District Court within ninety (90) calendar days from the date that you receive this decision. In his underlying complaint, Complainant alleged he was subjected to discrimination on the bases of disability and in reprisal for protected activity when: (1) in 2012, retired New York Police department (NYPD) detectives made slanderous statements against Complainant questioning his career with the Agency; (2) in 2013, retired NYPD detectives accused him of impersonating a federal agent; (3) Complainant and his family were criminally violated by electronic surveillance and drones constantly surveilling him and his family at his dwelling and flashing lights on and off causing mental stress; (4) Complainant witnessed an employee of a motorcycle organization surveilling his home; and (5) on February 6, 2017, Complainant became aware that the Agency and the FBI were working together in a joint task to conspire against him. 1 This case has been randomly assigned a pseudonym which will replace Complainant’s name when the decision is published to non-parties and the Commission’s website. 0520180358 2 The Agency dismissed Complainant’s complaint pursuant to 29 C.F.R. § 1614.107(a)(1), for failure to state a claim. Complainant appealed the Agency’s dismissal to the Commission. In our previous decision we affirmed the Agency’s dismissal of Complainant’s complaint.
