MCLAMB Petitioner and AMALGAMATED TRANSIT LOCAL 1764 Intervenor Case 05-RD-141298 DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered objections to a secret-ballot election held January 13 and 14, 2015, and the Hearing Officer's report recommending disposition of them. The election was conducted pursuant to a Decision and Direction of Election. The tally of ballots shows 209 ballots cast for the Intervenor, and 54 ballots cast against the participating labor organization. There were 13 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the Hearing Officer's report within the time provided. Accordingly, the Board adopts the Hearing Officer's findings and recommendations, and finds that a certification of representative should be issued.1 1 The Hearing Officer recommended overruling the Petitioner’s objections in their entirety. 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for Amalgamated Transit Local 1764 and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full-time and regular part-time bus operators, mechanics, dispatchers, maintenance clerks and gatekeepers employed by the Employer at its Capitol Heights facility, but excluding office clerical, managerial, guards and supervisors as defined by the Act.
