Employer and INTERNATIONAL UNION OF PAINTERS AND ALLIED TRADES, DISTRICT COUNCIL 51, AFL-CIO Petitioner Case 05-RC-117169 DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered an objection to a mail-ballot election held between February 28, 2014 and March 14, 2014, and the hearing officer's report recommending disposition of them. The election was conducted pursuant to a Decision and Direction of Election. The tally of ballots shows 28 ballots cast for and 13 ballots cast against the Petitioner, with 6 void ballots and 13 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations, and finds that a certification of representative should be issued.1 1 The Hearing Officer recommended that the Employer’s Objection 3 be overruled in its entirety. CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for International Union of Painters and Allied Trades, District Council 51, AFL-CIO and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All employees employed by the Employer, excluding all project managers, recycling supervisors, clerical employees, managerial employees, professional employees, guards, and supervisors as defined by the Act.
