Case No. R-3&7 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES April 2, 1942 On February 18, 1942, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in 'the above-entitled proceeding.' Pursuant to the Direction of Election, an election by secret ballot was conducted under the direction and supervision of the Regional Director for the Sixteenth Region (Fort Worth, Texas). On March 17, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report on the ballot. No objec- tions to the conduct of the ballot or the Election Report have been filed by any of the parties. . As to the balloting and its results, the Regional Director reported as follows : Total on eligibility list------ -------------------------------- 393 Total ballots cast------------------------------------------- 198 Total ballots challenged------------------------------------- 4 Total blank ballots----------------------------------------- 0 Total void ballots------------------------------------------- 0 Total valid votes counted------------------------------------ 194 Votes cast for Telegraph Workers Federal Labor Union #22679_ 162 Votes cast against Telegraph Workers Federal Labor Union #22679--------------------------------------------------- 32 On March 9, 1942, The Western Union Telegraph Company and Telegraph Workers Federal Labor Union #22679 entered into a stipulation, providing for the exclusion of managers and chief op- erators in the functional offices located in the Third District of the Gulf Division. R B., No. 15. 98 THEE WESTERN UNTGN TELEGRAPH COMPANY 99) exclude such employees from the unit for which the Union is certified' below.2 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, - IT Is HEREBY CERTIFIED that Telegraph Workers Federal Labor Union #22679, District No. 3 Chapter, affiliated with the American Federation of Labor,, has been designated and selected by a ma- jority of all employees in the offices located in District No. 3 of the Gulf Division of The Western , Union Telegraph Company, including regular and part-time messengers and managers,, but ex- cluding employees in divisional cities, temporary employees, and'_ managers and chief operators in the functional offices in the Third District of the Gulf Division, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9,(a) of the, Act, Telegraph Workers Federal Labor Union #22679, District No._ 3, Chapter, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment. 2 There are only four such employees in the Third District of the Gulf Division of the Company who sought to vote in the election.
