Mr Louis Cokvn, of counsel to the Board DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by United Steelworkers of America, (CIO), herein called the United, alleging that a question affecting commerce had arisen concerning the representation of employees of The Timken Roller Bearing Company, herein called the Company, engaged in Canton, Ohio, in the production of bear sings, steel, tubing, and rock bits, the National Labor Relations-Board provided for an appropriate hearing upon due notice On July 1, 1942, before a hearing was held, the Company, the United, Independent Bearing Woi ken s Association, herein called the Independent, Bearing Workers Organizing-Com- mittee, herein called the Committee, and the Regional Director for the Eighth Region (Cleveland, Ohio), entered into a "Stipulation for Cei tification Upon Consent Election " Pursuant to the stipulation, elections by secret ballot were con- ducted on July 14, 1942, under the direction and supervision of the Regional Duectoi, among (1) all production and mautenance work- ers in the bearing steel and tube plants of the Company at Cantoril, 42NLRB,No217 _ 1190 THE TIMKEN ROLLER- BEARING COMPANY 1191 1 Ohio, the steel and tube plant at Gambrinus, Ohio, and the plants at Wooster and Mt Vernon, Ohio; excluding foreman, assistant foremen or supervisors in charge of any class of labor, bricklayers, watch- men, guards, factory clerks of other clerical workers, and salaried employees, to determine whether or not they desired to be represented - by the United for the purposes of collective bargaining, (2) all production and maintenance workers at the Columbus, Ohio, plant of the Company, excluding foremen, assistant foremen or superx isors in charge of any class of labor, bricklayers, watchmen, guards, factory clerks or other clerical workers, and salaried employees, to determine whether they desired to be represented by the United, or by the Independent, for the pun poses of collective bar gaining, or by neither; and (3) all production and maintenance workers at the Gambrmus, (Oro, bean mg plant of the Company, excluding foremen, assistant foremen or supervisors in charge of any class of labor, bricklayers, watc,hnren, guards, factoi.y clerks or other clerical workers, and sal- aried employees, to determine whether they desired to be represented by the United, or by the Committee, for the purposes of collective bargaining, or by neither On July 17, 1942, the Regional Director issued and duly served upon the parties a Report on Elections. A question affecting commerce has arisen conceining the rep- resentation of employees of The Timken Roller Bearing Company, Canton , Ohio, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2 All production and maintenance workeis at the beating , steel, and tube plants at Canton, Ohio, the steel and tube plant and bear- ing plant at Gambrinus, Ohio, and thb plants at Wooster , Mt. Ver- non, and Columbus, Ohio, of the Company, excluding foremen , assist- ant foremen ' or supervisors in charge of any class of labor, brick- layers, watchmen , guards, factory clerks or other clerical workers, and salaried employees , constitute a unit appropriate for the pur- poses of collective bargaining , within the meaning of Section 9 (b) of the Act. 3 United Steelworkers of America , affiliated with the Congress of Industrial Organizations , has been designated and selected by a majority of the employees in the unit set forth in paragraph 2 above as their representative for the purposes of collective bargaining and is the exclusive representative of all employees in said unit , within the meaning of Section 9 (a) of the Act CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by, Section 9 (c) of the National Labor Rela- tions Act, r THE TIMKEN ROLLER BEARING COMPANY 1193 IT Is HEREBY CERTIFIED that United Steelworkers of America, affil- iated with the Congress of Industrial Organizations, has been desig- nated and selected by a majoiity of all production and maintenance workers in the bearing, steel, and tube plants at Canton, Ohio, the steel and' tube plant and bearing plant at Gambrinus, Ohio, and' the plants at Wooster, Mt. Vernon, and Columbus, Ohio, of The Timken Roller Bearing Company, excluding foremen, assistant foremen or supervisors in charge-of any class of labor, bricklayers, watchmen, guards, factory clerks or other clerical workers, and salaried em- ployees, as their representative for the purposes of collective bar- gaining, and that, pursuant to Section 9 (a) of the Act, United Steelworkers of America, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect-to rates of 'pay, wages, hours of employment, and other conditions of employment.
