Pursuant to the Direction of Election, an election by secret ballot was conducted on September 25, 1941, under the direction and supervision of the Regional Director for the Sixteenth Region (Fort Worth, Texas). On September 27, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. No objec- tions to the conduct of the ballot or to the Election Report were filed by any of the parties. IT IS HEREBY CERTIFIED that International Union of Operating Engi- neers, Local No. 472 has been selected by a majority of all production 1 35 N. L. R. B., No. 77. 36 N. L . R. B., No. 139. 648 THE TEXAS COMPANY 649 and maintenance employees of The Texas Company at its West Dallas Works, West Dallas, Texas, refinery, excepting supervisory employees who have the right to hire and discharge or to recommend hiring or discharging, and clerical employees, as their representative for the purposes of collective bargaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, International Union of Operating Engineers, Local No. 472 is the exclusive repre- sentative of all such employees for the purposes of collective bargain- ing with respect to rates of pay, wages, hours of employment, and other conditions of employment.
