Mr Mozart G Ratner, of counsel to the Board DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by the Textile Workers Union of America (C. I: O ), acting in behalf of its Local Union No 452, herein called the C I O , alleging that a question affecting commerce had arisen concerning the representation of employees of The Riverside & Dan River Cotton Mills, Incorporated, herein called the Company, en- gaged in Danville and in the County of Pittsylvania, Virginia, in the manufacture and sale of textile products, the National Labor Relations Board provided for an appropriate hearing upon due notice. On June 18, 1942, before a hearing was held, the Company, C I 0, and the Regional Director for the Fifth Region, Baltimore, Mary- land, entered into a "STIPULATION FOR CERTIFICATION ON CONSENT ELECTION " Pursuant to the Stipulation, an election by secret ballot was con- ducted on June 26, 1942, under the direction and supervision of the Regional Director among all production and maintenance workers employed by the Company in connection with its textile manufactur- ing plants, village and properties, located both in the city of Dan- ville, Virginia (Riverside Division) and in the County of Pittsyl- vanil, Viiginia (Dan River Division), including canteen employees, laboratory workers (except professonal graduate chemists), and maintenance employees engaged in repair and maintenance of village and other properties outside the plant proper; but excluding em- 42 N L R B, No 163 843 844 DECISIONS OF NATIONAL LABOR RELATIONS BOARD ployees on the pay ioll at Hylton Hall dormitory, the Fitzgerald Apartment, Schoolfield Coal and Wood Company, the two-company cloth stores, and all executive, supervisory, and clerical employees, to determine whether or not they desire to be represented by the C I 0 for the purposes of collective bargaining On June 30, 1942, the Regional Director issued and duly served on the parties an Elec- tion Report on the ballot. No objections to the conduct of the ballot or the Election Repoit have been filed by any of the paities As to the balloting and its results, the Regional Director ieported as follows. FINDINGS OF FACT Y A question affecting commerce has arisen conceimng the repre- sentation of employees of The Riveiside & Dan River Cotton Mills, Incorporated , Danville, Viigmia, and County of Pittsylvania, Vir- ginia, within the meaning of Section 9 (c) and Section 2 (6) and, (7) of the National Labor Relations Act 2 All production and maintenance woikeis employed by the Com- pany, in connection with its textile manufacturing plants , village and properties located both in the city of Danville , Virginia (Riverside Division ), and in the County of Pittsylvania , Virginia ( Dan River Division ), including canteen employees , laboratory workers (except piofessional graduate chemists ), and maintenance employees engaged in repair and maintenance of village and other properties outside the plant proper, but excluding employees on the pay roll at Hylton Hall dormitory , the Fitzgei ald Apai tment , Schoolfield Coal and Wood Company, the two company cloth stores , and all executive , supervisory, and clerical employees , constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 ( b) of the Act 3 Textile Workers Union of America , Local Union No 452, C I O , has been designated and selected by a majority of the employees in THE RIVERSIDE & DAN' RIVER COTTON MILLS, INC 845 the above 'unit as their representative for the purposes of collective bargaining and is the exclusive representative of all employees in said unit within the meaning of Section 9 (a) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Boaid by Section 9 (c) of the National Labor Relations Act, IT IS HEREBY CERTIFIED that Textile Workers Union of America, Local Union No 452, C I O , has been designated and selected by a majority of all production and maintenance workeis employed by the Company, in connection with its textile manufacturing plants, village and properties located both in the city of Danville, Virginia (River- side Division), and in the County of Pittsylvania, Virginia (Dan River Division), including canteen employees, laboratory workers (except professional graduate chemists), and maintenance employees engaged in repair, and maintenance of village and other properties outside the plant proper, but excluding employees on the pay roll of Hylton Hall dormitory, the Fitzgeiald Apartment, Schoolfield Coal and Wood Company, the two company cloth stores, and all executive, supervisory, and clerical employees, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, Textile Workers Union of America, Local Union 452,, C. I 0, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
