Mr Howard Seren, of Toledo, Ohio, for the C I 0 Mr E J kelley, of Toledo, Ohio, for the A F L Mary M Persinger, of counsel to the Board DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by International Union, United Auto- mobile, Aircraft & ,Agricultural Implement `Yorkers of America, Local 12, affiliated with the C I 0, herein called the C I 0, alleg- ing that a question affecting commerce had arisen concerning the rep- i esentation of employees of The Peters Stamping Company, Perrys- burg, Ohio, herein called the Company, engaged at its plant in Perrysburg, Ohio, in the manufacture of sheet-metal stamps, the Na- tional Labor Relations Board provided for an appropriate hearing upon due notice On July 10, 1942, before a hearing was held, the Company, the C I 0, International Association of Machinists, Dis- ti ict 57, affiliated with the A F of L., herein called the A F of L , and the Regional Directoi. for the Eighth Region (Cleveland, Ohio) entered into a "stipulation for consent election and certification by the National Labor Relations Board " Pursuant to the stipulation, an election by secret ballot was con- ducted on July 23, 1942, under the direction and supervision of the Regional Director, among all employees of the Company at its Perrysburg, Ohio, plant, excluding office employees, those having the iight to hue and discharge, tool and die makers, and Anna Kay and 42NLRB,No252 1409 472814-42--89 1410 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Ruth Reid, to determine whether they desired to be represented by the C I O , by the A F L , or by neither On July 27, 1942, the Regional Director issued and duly seived upon the parties an Elec- tion Report on the ballot No objections to the conduct of the ballot or to the Election Repoit have been filed by any of the parties. As to the balloting and its results, the Regional Director repoi ted as follows Total on eligibility list-------------------------------------- 79 Total ballots cast------------------------------------------- 74 Total ballots challenged------------------------------------- 0 Total blank ballots------------------------------------------ 0 Total void ballots------------------------------------------- 0 Total valid votes counted----------------------------------- 74 Votes cast for Inteinational Association of Machinists, District 57, (A F L )-------------------------------------------- 16 Votes cast for International Union, United Automobile, Aircraft & Agricultuial Implement Workeis of America, Local 12, (C I 0 )------------------------------------------------ 57 Votes cast for neither-------------------------------------- 1 Upon the basis of the stipulation, the Election Report, and the entire record in the case, the Board makes the following FINDINGS OF FACT 1 A question affecting commerce has arisen concerning the repre- sentation of employees of The Peteis Stamping Company, Peirysburg, Ohio, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act 2 All employees of the Company at its Perrysburg, Ohio, plant, excluding office employees, those having the 11 ght to hire and discharge, tool and die makers, and Anna Kay and Ruth Reid, constitute a unit i,ppropriate for the purposes of collective bargaining within the mean- ing of Section 9 (b) of the Act 3 International Union, United Automobile, Aircraft & Agricul= tural Implement Workers of America, Local 12, affiliated with the Congress of Industrial Organizations, has been designated and selected by a majority of employees in the above unit as their repre- sentative for the purposes of collective bargaining and is the exclusive representative of all employees in said unit, within the meaning of Section 9 (a) of the Act CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act; IT IS HEREBY CERTIFIED that Intel national Union, United Automobile, Aircraft & Agricultural Implement Workers of America, Local 12, THE PETERS STAMPING COMPANY 1411 affiliated with the Congress of Industrial Organizations , has been designated and selected by a maj oiity of all employees of the Company at its Perrysburg , Ohio, plant , excluding office employees, those having the right to line and discharge , tool and die makers, and Anna Kay and Ruth Reid, as their representative for the purposes of collective bargaining , and that, pursuant to Section 9 (a) of the Act , Interna- tional Union, United Automobile, Aircraft & Agricultural Implement' Workers of America, Local 12, affiliated with the Congress of Indus- trial Organizations , is the exclusive representative of all such em- ployees for the purposes of collective bargaining with respect to rates of pay, wages , hours of employment , and other conditions of employment Copy with citationCopy as parenthetical citation
