Case No. R-361.9 SUPPLEMENTAL DECISION AND DIRECTION OF RUN-OFF ELECTION May 25, 1942 On April 3, 1942, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.1 Pursuant to the Direction of Elec- tion, an election by secret ballot was conducted on April 27, 1942, under the direction and supervision of the Regional Director for the Nineteenth Region (Seattle, Washington). On April 30, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report on the balloting. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. As to the balloting and its results, the Regional Lirector reported as follows : Total on eligibility list--------------- ---- --------------------- 132 Votes cast for lumber & Sawmill Workers Union, Local 2898, A. F. of L--------------------------------------------- 29 Votes cast for International Woodworkers of America, Local No. 6-12, C. 1. 0---------- -------------------- 48 Votes cast for neither------------------------------------ 35 Total challenged ballots----------------------------------- None Total blank ballots--------------------------------------- None Total void ballots----------------------------------------- None Total valid votes cast------------------------------------- 112 On April 28, 1942, International Woodworkers of America, Local No. 6-12, C. 1. 0., filed a request for a run-off election to be held by the Board. Although neither of the competing labor organiza- tions in the election received a majority of the votes cast, the results 140 N I, E B 175 41 N. Accordingly, we shall direct a run-off election in which such employees will be given an opportunity to decide whether they desire to be represented 'by International Woodworkers of America, Local No. 6-12, C. I. 0., or by Lumber & Sawmill Workers Union; Local 2898, A. F. of L., for the purposes of collective bargaining. DIRECTION OF RUN-OFF ELECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, it is hereby DIRECTED that, as part of the investigation authorized by the Board to determine representatives for the purposes of collective bargaining with The Long-Bell Lumber Company of Klamath Falls, Oregon, an election by secret ballot shall be conducted as early as possible, but not later than thirty (30) days from the date of this Direction of Run-off Election, under the direction and supervision of the Re- gional Director for the Nineteenth Region, acting in this matter as agent for the National Labor Relations Board, and subject to Article III, Section 9, of said Rules and Regulations, among the employees described in the Direction of Election issued on April 3, 1942, but excluding those who have since quit or been discharged for cause, to determine whether they desire to be represented by International Woodworkers of America, Local No. 6-12, C. I. 0., or by Lumber & Sawmill Workers Union, Local 2898, A. F. of L., for the purposes of collective bargaining. Case No. R-3619, CERTIFICATION OF REPRESENTATIVES June 26, 1942 On April 3, 1942, the National Labor Relations Board issued a Decision and Direction of Election' and on May 25, 1942,--a Supple- mental Decision and Direction of Run-Off Election 2 in the above- entitled proceedings. Pursuant to the Direction of Run-Off Election, a run-off election was conducted on June 5, 1942, under the direction and supervision of the Regional Director for the Nineteenth Regidn (Seattle, Washington). On June 9, 1942, the Regional Director, act- ing pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties a Run-Off Election Report. No objections to the conduct of the ballot or to the Run-Off Election Report were filed by any of the parties. I. 0., has been designated and selected by a majority of the production and maintenance employees of The Long- Bell Lumber Company, Klamath Falls, Oregon, at its mill at Klam- ath Falls, Oregon, including Art Shuck, but excluding supervisory and clerical employees, as their representative for the purposes of collective bargaining and that pursuant to Section 9 (a) of the Act, International Woodworkers of America, Local No. 6-12, C. I. 0., is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
