Case No. R-3210 SUPPLEMENTAL DECISION AND ORDER January J, 1940 On November 14, 1941, the National Labor Relations Board issued a Decision and Direction of Election in the above-entitled proceeding., On December 5, 1941, the Board denied the request of United Cannery, Agricultural, Packing and Allied Workers of America, C. I. 0., herein called the United, to withdraw its petition herein. Thereafter, the United was permitted to withdraw its name from the ballot. Pursuant to the Direction of Election an election by secret ballot was conducted on December 10, 1941, under the direction and supervision of the Regional Director of the Tenth Region (Atlanta, Georgia). On December 15, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. L. R. B: 911. 38 N. L. R. B., No. 7. 35 36 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Cudahy Packing Company in the unit heretofore found to be appro- priate for collective bargaining. We will, therefore, dismiss the peti- tion for investigation and certification of representatives of employees of the Company. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and certifi- cation of representatives of employees of The Cudahy Packing Com- pany, Memphis, Tennessee, filed by United Cannery, Agricultural, Packing and Allied Workers of America, C.
