Case No. 1i-148 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES November 17, 1939 On October 19, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above entitled proceedings., On October 27, 1939, Goodrich Local Number 5, United Rubber `Yorkers of America, filed a motion for rehearing, which was denied by the Board. Pursuant to the Direc- tion of Election, an election by secret ballot was conducted on Octo- ber 31, 1939, under the direction and supervision of the Regional Director for the Eighth Region (Cleveland, Ohio). On November 1, 1939, the Regional Director, acting pursuant to Article III, Sec- tion 9, of National Labor Relations Board Rules and Regulations- Series 2, issued and duly served upon the parties his Election Report. No Objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. B., No. 66. 757 758 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Upon the entire record in the case, the Board makes the tullowing : SUPPLEMENTAL FINDING OF FACT In its Decision, the Board made no final determination as to the appropriate unit for the purposes of collective bargaining pending the election. The Board stated that if a majority of the wood and metal pattern makers and pattern makers' apprentices voted for the Pattern Makers League of North America, they would constitute a unit separate from the other employees. We find that the wood and metal pattern makers and pattern makers' apprentices employed by The B. F. Goodrich Company, Akron, Ohio, constitute a unit appropriate for the purposes of col- lective bargaining and that said, unit will insure to employees of The B. F. Goodrich Company the full benefit of their right to self- organization and to collective bargaining and otherwise effec- tuate the policies of the Act. SUPPLEMENTAL CONCLUSION OF LAW The wood and metal pattern makers and pattern makers' appren- tices employed by The B. F. Goodrich Company, Akron, Ohio,.con- stitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the National Labor Relations Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board, by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board-Series 2, IT IS HEREBY CERTIFIED that Pattern Makers League of North America has been designated and selected by a majority of all the wood and metal pattern makers and pattern makers' apprentices employed by The B. F. Goodrich Company, Akron, Ohio, as their representative for the purposes of collective bargaining, and that pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, Pattern Makers League of North America is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
